1. Acceptance

By using The New Girl ("TNG"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use TNG.

2. Eligibility and Availability

• You must be 18 years of age or older. TNG is not for minors.
• TNG isn't available in the UK. Current UK age‑assurance rules for adult services require intrusive identity checks and data retention. As a privacy‑first product, we don't collect or store that kind of data, so we've chosen not to operate in the UK.
• We may suspend, refuse, or terminate access to enforce these restrictions.

3. Your Account

• Provide accurate information and keep your credentials secure.
• Use a valid email address you can send emails from. This is required for identity verification when contacting support for password recovery, billing disputes, refund requests, account issues, or any other customer service matters. We cannot assist with account-related inquiries if we cannot verify your identity through your registration email address.
• One account per person; do not share your account.
• Tell us promptly about unauthorised use.

4. Subscriptions and Billing

• Paid plans auto‑renew. You authorise us to charge the recurring fee until you cancel.
• Prices and taxes are shown at checkout. We will give reasonable advance notice of price changes.
• Cancel any time via account settings or by emailing support before the renewal date. Cancellation takes effect at the end of the current billing period.
• Refunds: we will refund duplicate charges, fraud on our systems, or where required by law. Otherwise, fees are non‑refundable. Your statutory rights are unaffected.

5. Prohibited Uses and Content

• Anything illegal or that infringes others' rights.
• Harassment, exploitation, doxxing, or threats.
• Malware, scraping, reverse engineering, or security bypass.
• Requests for or depictions of minors, age‑play, incest, sexual violence, trafficking, bestiality, or non‑consensual acts.
• Self‑harm instructions or encouragement of suicide or eating disorders.
• Uploading files or media to TNG.
• Falsely representing that content generated by TNG is your own, or altering outputs to misrepresent them as official TNG statements.

6. Anti-Trafficking Policy

This platform prohibits human trafficking activities. Users interact exclusively with AI characters and cannot upload images, communicate with each other, or message other users. We actively monitor all content for suspicious activity including potential trafficking indicators and will immediately report any violations to law enforcement as required by law.

7. User Content and AI Outputs

• You are responsible for your prompts and use of outputs. User uploads are not permitted.
• Subject to third‑party rights and these Terms, you may use outputs for your own purposes.
• You grant us a worldwide, royalty‑free licence to host, process, and display your content and outputs as needed to provide, secure, and maintain TNG.
• We will use your image outputs for service improvement, training, and other business purposes. By using TNG, you acknowledge and agree that we may retain, analyze, and utilize all image outputs generated through our service.
• AI-generated images created through TNG do not qualify for copyright protection under U.S. federal law, as they are created solely by artificial intelligence without human authorship. You acknowledge that you do not acquire any intellectual property rights to AI-generated images produced by TNG.

8. Complaints and Takedowns

Report concerns in‑app or by emailing [email protected]. We will review and act where required by law or our policies. For copyright notices, include identification of the work and material, your contact details, and a sworn statement of good faith ownership.

9. Disclaimers and Liability

• TNG is provided "as is" without warranties.
• To the maximum extent permitted by law, we are not liable for indirect or consequential losses.
• Our total liability for any claim is limited to the amount you paid in the 12 months before the claim.
• We may change, suspend, or discontinue features at any time.
• AI outputs may be inaccurate, incomplete, or out of date. Do not rely on TNG for professional, medical, legal, or safety‑critical advice.
• TNG is a fictional, AI‑mediated experience. We encourage healthy relationships and real human connection; bring any positive communication skills from TNG into your real world where it makes sense.
• TNG currently supports English only. We have not yet fine‑tuned our models for other languages, so using non‑English may produce unpredictable or inappropriate responses.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming and applicable US federal law. Disputes will be resolved exclusively in the state or federal courts in Sheridan County, Wyoming.

11. Changes to these Terms

If we make material changes, we will post an updated version and effective date. Continued use means you accept the changes.

Complaints & Takedowns

Use in‑app reporting or email [email protected] to report illegal, non‑consensual, or policy‑violating content. Provide relevant links, timestamps, and your contact details.

We will make commercially reasonable efforts to review and act in line with law and our policies. Nothing here limits our ability to remove content at our discretion.
